If you do not agree with any part of these terms, please do not purchase or use our products and services.

1. DIGITAL PRODUCTS & LIMITED LICENSE

1.1. All products sold on this website consist exclusively of intangible digital audio downloads (such as brainwave entrainment, binaural beats, isochronic tones, subliminals, and related sound therapies).

1.2. Purchasing an audio file does not transfer ownership of the intellectual property or copyright. Upon successful payment, the Company grants you a personal, non-exclusive, non-transferable, and perpetual license to use the downloaded audio for private, personal use.

1.3. You may not resell, rent, sublicense, redistribute, broadcast, reproduce, modify, or upload these audio files to any public or streaming platform (including YouTube, Spotify, etc.) for commercial purposes or mass distribution without prior written consent from Brainwave Labs.

2. DOWNLOAD LIMITS, EXPIRATION, AND BACKUP POLICY

2.1. Access Restrictions: To ensure server security and prevent unauthorized sharing, each purchase grants access to download the acquired audio files subject to the following limitations:

• Download Limit: A maximum of ten (10) download attempts per audio file.
• Time Expiration: An access period of one (1) year (365 consecutive days) starting from the date and time of purchase confirmation.

2.2. Termination of Download Access: Access to the download link on our servers will permanently expire upon whichever event occurs first:

• The Customer reaches the maximum limit of ten (10) downloads.
• The one (1) year period from the purchase date elapses.

2.3. Customer Backup Responsibility: It is solely the Customer's responsibility to download the files within the designated timeframe and store them securely on a local hard drive, external storage device, or private cloud storage.

2.4. Once the download link expires or download attempts are exhausted, the Company is under no legal obligation to restore access for free. If you lose your files after your access period has expired, a new purchase will be required to obtain a new download link.

3. NO REFUNDS & WAIVER OF WITHDRAWAL RIGHTS

3.1. Due to the digital and irrevocable nature of downloadable media and immediate delivery upon payment, all sales are final and non-refundable.

3.2. By completing your purchase, you expressly acknowledge that access to digital content is provided immediately and you agree to waive any statutory right of withdrawal, cancellation, or refund once the download link or file delivery has been initiated.

3.3. In the event of a technical defect or corrupted file caused by our server, the Customer must notify our support team within fifteen (15) days of purchase for a replacement or technical resolution.

4. HEALTH & MEDICAL DISCLAIMER

4.1. The audio frequencies and programs provided by Brainwave Labs are intended strictly for educational, relaxation, meditation, and personal enrichment purposes. They do not constitute medical, psychiatric, or psychological diagnosis, treatment, or therapy.

4.2. Our audio products must never be used as a substitute for professional medical advice, diagnosis, or care.

4.3. Mandatory Safety Warnings & Contraindications:

• Epilepsy & Neurological Conditions: Brainwave frequencies and rhythmic audio stimulation can affect neural activity. Do not use our audio files if you have a history of epilepsy, seizures, or other serious neurological disorders without prior consultation with a licensed physician.
• Medical Devices: Individuals using pacemakers or other implanted biomedical devices must consult their doctor before using frequency-based audio.
• Driving & Heavy Machinery: NEVER listen to brainwave audio (especially alpha, theta, or delta frequencies) while driving a motor vehicle, operating heavy machinery, or engaging in any activity that requires active alertness.

4.4. All use of our audio products is strictly at your own risk. Brainwave Labs disclaims all liability for any misuse or failure to follow safety guidelines.
